Contentious
- Acted for an international main contractor against sub-contractors and project partners in multiple arbitrations arising from a major rail project, each under different institutional rules and governing laws, including those of Singapore and the People’s Republic of China. The claims involved exceed US$35 million.
- Acted as Singapore counsel for a government in an International Chamber of Commerce arbitation on a contractual dispute arising out of a high-profile bid for a complex and large-scale construction project (Terminal 3 of the Ninoy Aquino International Airport). The claim is valued at more than US$500 million and the counterclaims approach US$1b.
- Acted for a Malaysian consortium in claims and potential arbitration against an oil concession in North-East Africa in relation to a US$232 million Engineering Procurement Construction and Commission contract for a Marine Export Terminal Facilities for crude oil.
- Acted for a government in South East Asia in an international arbitration arising from the termination of a mining and power generation concession against the Thai concession holder with claims exceeding US$3.1 billion.
- Acted for the main contractor/concessionaire in a dispute with an international tunnelling company arising out of a construction of a network of interconnecting, multipurpose underground tunnels for storm water drainage and road traffic in one of the world's largest tunnelling projects, governed by Malaysian law. The claims involved exceed US$100 million.
- Acted for the developer involved in arbitration with the main contractor in Kuala Lumpur with hearing dates lasting more than 170 days arising out of the construction of a large retail cum residential project in Malaysia, governed by Malaysian law. The claims involved exceed US$5 million.
- Acted for one of the largest groups of Independent Power Producers in South East Asia on a number of disputes and arbitrations relating to power purchase agreements and EPC contract on defects with claims exceeding US$80 million.
- Acted for an international main contractor against a Government authority in respect of the construction of two subway stations and inter-connecting underground bored tunnels, governed by Singapore law. The claims involved are about US$100 million.
- Acted for an international main contractor against a Government rail authority in a dispute arising out of the construction of an underground cable tunnel in Hong Kong, governed by Hong Kong law. The claims involved exceed US$30 million.
- Acted for an independent power producer in a dispute arising out of an EPC Contract for the construction of a combined-cycle gas turbine power plant, governed by Malaysian law. The claims involved exceed US$50 million.
- Acted for a Malaysian EPC contractor in dispute with an international consortium developer of a marine export terminal for a crude oil development project in Sudan with claims exceeding US$200 million.
- Acted in an international arbitration between an Australian public listed company and a Thai conglomerate concerning the construction of a gas well fluid platform in the Gulf of Khambatt, India. The multimillion dollar dispute involved issues concerning delays, acceleration and variations.
- Acted for a contractor in disputes against a government authority involving an underground sewerage treatment facility, requiring the appointment of multiple technical experts to address complex geotechnical issues, governed by Hong Kong law. The claims involved exceed US$20 million.
- Acted for an international joint venture consortium against an airport authority in connection with a contract for the construction of elevated frontage roads at the Suvarnabhumi Airport at Bangkok, governed by Thai law. The claims involved about US$50 million.
- Acted for the main contractor involved in the High Court of Singapore over complex issues regarding allegations of defective work in a large scale industrial development with hearing dates lasting more than 30 days.
- Acted for an Australian integrated engineering and services contractor in an UNCITRAL Arbitration in relation to disputes relating to a coal mining project. Issues included amounts payable to contractor exceeding US$25million as a result of employer’s termination of mining pit, instruction to mine at new pits, applicable rates for mining works.
- Acted for an Australian integrated engineering and services contractor in a dispute claim involved liquidated damages, deviations to contract and loss of profit amounting to US$ 101 million in relation to the EPC Contract for a geothermal power plant in Asia.
- Acted for an Australian integrated engineering and services contractor in a dispute claim involved engineering design and consultancy services carried out for a geothermal power plant in Asia amounting to US$ 20 million.
- Acted for Tyco Fire, Security & Services Pte Ltd as the Plaintiffs in contract claims against the Defendants for approximately $17.5 million in relation to two sub-contracts for the Terminal 3, Singapore Changi Airport project. Issues involved in the dispute include contract; quantum meruit; prolongation and variation claims.
- Acted for on a dispute in relation to a coal mining contract and concession in East Kalimantan.
- Acted for an Australian-Indonesian joint venture contractor in relation to a multi-million dollar dispute concerning the construction of components for an offshore rig for an Australian-Indonesian party.
- Acted for a main contractor in an arbitration against the developer of a $40 million industrial building, on time-related issues, including completion, acceleration and extensions of time.
- Acted for a government authority to defend a $20 million claim brought by a property developer in respect of the construction-related issues in the aftermath of the Nicoll Highway Collapse.
- Acted for a main contractor in an arbitration with developer, on issues relating to delays and extensions of time on the construction of a $10 million residential development.
- Acted for an international contractor in relation to contractual disputes worth more than $15 million with their sub-contractors in relation to the Marina Bay Sands Integrated Resort project.
- Acted for an Australian integrated engineering and services contractor in a dispute claim involved liquidated damages, deviations to contract and loss of profit amounting to over US$ 10 million against an international design consultant for a geothermal power plant in Asia.
- Acted for an international contractor in an arbitration over the construction of a power plant in Malaysia. The quantum of the dispute is over RM 24million.
- Acted for a developer in a claim over the construction of a commercial development in Shanghai, PRC. The quantum of the dispute is over RMB50 million.
Non Contentious
- Advised the successful bidder on acquisition of Senoko Power from Temasek. Our client won the bid to buy Singapore’s largest power generation company from the state investment agency for S$3.65 billion (US$2.4 billion) in cash and S$323 million (US$213 million) in debt. The Senoko power plant auction was the second such sale by Temasek in its drive to divest all three of the city-state’s power plants before the end of 2009.
- Advised bidders on the acquisition of Tuas Power Ltd. from Temasek Holdings (Pte) Ltd. Tuas Power Ltd was ultimately sold for SGD 4.31 billion on March 14, 2008.
- Provided legal advice to the developer of a $1.2 billion renewable diesel production plant in Singapore.
- Advised an international consultant relating to a petroleum storage and handling terminal with a capacity of over 500,000 m3 in Sitra, the Kingdom of Bahrain.
- Advised an international consultant relating to the construction of a petroleum storage terminal in Fujairah, UAE.
- Advised a Singapore government entity on a Consultancy Agreement with the Ministry of Works of the Government of the Kingdom of Bahrain.
- Advised the Ministry of Economic Development & Trade of the Republic of Maldives in drafting of legislation for the development of special economic zones in the Maldives.
- Advised the Ministry of Economic Development & Trade of the Republic of Maldives in drafting, reviewing and advising on a suite of concession agreements in relation to the promotion and development of special economic zones in Gulhifalu, Maldives. The development includes:
- Reclamation of 93 hectares of land and a road network;
- Providing a ferry service for the transport of passengers, goods and vehicles ;
- Development of necessary utility infrastructure, including power, water and telecommunications to facilitate the commercial use of the reclaimed land;
- Developing infrastructure, buildings and facilities as are specified by the Company and required for the provision of government services such as customs, policing and port services.
- Advised the Ministry of Economic Development & Trade of the Republic of Maldives in drafting, reviewing and advising on a suite of concession agreements in relation to the proposal by Dubai World to undertake long term economic development in Hulhumale, Maldives. The development includes:
- A container port terminal set in an area of about 30 hectares with a 600 metre quay wall.
- A logistics/ distribution centre which will occupy an area equivalent to about 50 hectares.
- A 7 star resort and a 5 star resort with a combined bed capacity of 576.
- An entertainment complex with a modern retail development offering up market designer brands.
- Housing developments ranging for middle class range to luxury developments.
- Advised Renewable Energy Corporation, a major Norwegian solar cell manufacturer, in relation to the development and construction of Asia’s largest solar cell manufacturing facility, with project value in excess of $6.4 billion.
- Advised a Singapore government related entity in its consultancy services agreement for the $1.5 billion construction of the Doha North Sewage Treatment Plant project in Doha, Qatar.
- Advised a major earthworks and excavation specialist contractor on a $50 million contract in relation to a Marina Sands Integrated Resorts Project.
- Advised the developer in relation to all aspects of the development of an industrial city of approximately 150 acres in the state of Johor, Malaysia. The development cost of the project is expected to exceed S$ 800 million.
- Advised the successful bidder on Singapore law in relation to the Singapore Sports Hub Project which would be developed under a Public Private Partnership (“PPP”) structure. The Sports Hub will replace the current National Stadium and it comprises of a new 55,000-seater National Stadium with a retractable roof, an Aquatic Centre, a Multi-Purpose Indoor Arena, a water sports centre, the Singapore Indoor Stadium and supporting commercial facilities. It is estimated that the Government spending involved would be about S$1.9 billion and construction cost is estimated to be about S$1.2 billion.
- Advised a consortium in its bid for the ITE College West PPP Project. The new ITE College West will see the consolidation of ITE’s five current campuses into the new campus. The ITE PPP Project requires the Design, Build, Finance and Operation of the new ITE College West which will contain three key schools based together as ITE College West namely, the School of Business and Services; School of Info-Communications Technology; and School of Engineering. The new ITE College West is envisaged to be a flexible, scalable and innovative campus that is recognised globally and adapts readily to the ever changing education environment. It is envisaged that the new ITE College West will be a distinctive campus that can house a student capacity of 7200 full time students, 8100 part time students and approximately 630 staff.
- Advised Chevron in drafting construction contracts for its fuel oil systems and facilities at one its oil terminals.
- Advised a major Indian company Certus, a Subsidiary of Tamilnadu Petroproducts Ltd in the setting up of a petrochemical plant with a capacity of 100,000 MTPA Normal Paraffin at Jurong Island, Singapore. Contracts on which we advised were the EPCM contracts, consultants’ contracts, process licensing contracts and offtake agreements.
- Advised an American architectural firm in relation to consultancy contracts with the Singapore Government on a $400 million research facility project.
- Advised an French architectural firm in acting in a consortium with other major architectural, engineering and quantity surveying consultants in design and consultancy contracts with a Singapore government agency on a $400 million major Arts Centre project.
- Advised a major power transmission company in Singapore in the review of all tender documents and construction contracts.
- Advised the Land Transport Authority of Singapore and reviewed related contracts on the construction of the new Downtown Line.
- Advised the Singapore Government related organisers of the international event known as the Singapore International Water Week (SIWW). SIWW is a platform to attract new investments into Singapore, increase R&D opportunities and showcase Singapore capabilities in the field of water and environment. It focuses on practical water technology and business solutions, best practices in the successful delivery of various aspects of water resource and wastewater management. SIWW is positioned as a complementary forum to existing well-recognised global water forums such as Stockholm World Water Week and World Water Forum.
- Advised Chevron in the review of EPCM contract for a Detergent Expansion Project valued at about $50 million at Jurong Island, Singapore.
- Advised the Government of Singapore Investment Corporation (GIC) on project development and management contracts on projects in Tokyo, Japan, in conjunction with a major Japanese conglomerate.
- Advised United Premas Limited in the review on a suite of facility management contracts in relation to the undertaking of facility management services to various institutions, including a university and the Singapore office of an international news agency.
- Advised a Joint Venture party in relation to a major property development project in India.
- Advised Toll (Asia) Pte Ltd in relation to all aspects of the development of a Logistic Centre in Bangalore, India.
- Advised a joint venture party in relation to all aspects of the development of the Port West Project in Gujarat, India, a $300 million port development project.
