Contentious matters

Our IP disputes and enforcement lawyers are engaged in civil litigation for trademark, copyright and patent infringement, misuse of trade secrets and passing off, in arbitrations concerning disputes arising from IP licensing agreements, and in criminal prosecutions for trademark and copyright offences.

We work regularly with private investigators to secure evidence of infringement, and to institute civil, administrative and criminal proceedings against the infringers. We negotiate royalty payments with licensing societies, and assist our clients in obtaining pre-emptive remedies such as Anton Piller orders, criminal search warrants and injunctions.

Non-contentious matters

Our IP registration lawyers handle various portfolios of trade marks, patents, registered designs and domain names. We manage an active regional trade mark portfolio, and typically advise our clients on the suitability of marks for registration, the prospects of obtaining registration of marks, the selection and use of trademarks, and oppositions to pending trademark applications.

We file and prosecute domestic as well as international trade mark applications (under the Madrid Protocol), and advise on the documentation required for the assignment and licensing of trade mark rights. In addition, we handle design and patent filings, both locally as well as overseas, and manage the registration of gTLD and ccTLD domain names (including multi-lingual domain names) on a global basis.

Corporate IP

Our corporate Intellectual Property practice undertakes a wide range of work including advising on distributorship, franchise and licensing arrangements, advertising, labeling and product regulatory requirements. We also draft and negotiate technology transfer, software supply, implementation and maintenance agreements, and provide support in corporate due diligence exercises and IP audits.
